Use your media. Respect everyone else's.

1. Who provides what

Victor Gumiński publishes the Onyx website and software through the Onyx Media Center project in Norway. A person or organization that installs and runs an Onyx server is the "server operator". The publisher does not operate every server, control its media library or receive its account data.

A server operator may present a server-specific copy of these terms that identifies their contact, access rules and local service details. Those additions apply to that server. They cannot remove rights you have under mandatory law.

2. Accepting the terms

By downloading, installing, running or using Onyx after the effective date, you agree to these terms. Account creation also presents the applicable terms before sign-up and records the version accepted. If you do not agree, do not create an account or use the software. You may uninstall the apps and ask the server operator to delete an existing account.

You must be able to enter a binding agreement where you live. A parent or guardian must approve use by a child who cannot enter the agreement alone.

3. Permission to use Onyx

Subject to these terms, the publisher gives you a limited, non-exclusive, non-transferable and revocable permission to download, install and use the released Onyx applications for lawful personal or household purposes. Onyx is provided without a subscription fee. This permission does not transfer ownership of the software, branding, artwork or documentation.

Third-party components keep their own license terms. Builds include LibVLC and its required notices under the GNU Lesser General Public License. Those notices ship with each app and are not limited by these terms.

4. Accounts and server access

• Use accurate account information and protect your password and devices.
• An account belongs to one independently operated server environment. It does not create a right to use another household's server or library.
• The server operator decides who the server serves and may use an email allow list. A refused account may still use the in-app deletion flow.
• Do not share account tokens, stream tickets or authenticated download links.
• Tell the server operator promptly if you believe an account or device has been compromised.

5. Media rights

You and the server operator are responsible for the media placed in, indexed by or streamed through a server. Use only material you own, have permission to use, or may lawfully use under an applicable exception.

Norwegian Copyright Act section 26 permits limited copying of a lawfully published work for private use, subject to its conditions. It does not give permission to make that copy available to the public. Do not open a household library to people outside the private circle unless the relevant rights permit it.

6. Prohibited use

You must not use Onyx to:

• store, stream, distribute or promote illegal material or material you have no right to use;
• infringe copyright, privacy, confidentiality or other rights;
• access another profile, library, server or device without permission;
• bypass authentication, access restrictions, rate limits or security controls;
• introduce malware, disrupt a service, scan for vulnerabilities without authorization or interfere with other users;
• misrepresent your identity, the source of a build, or an affiliation with the Onyx project; or
• use Onyx in a way that violates applicable law or causes the publisher or operator to violate it.

7. Radio and other providers

Radio listings come from the community Radio Browser catalogue. Streams, station logos, authentication, hosting and downloads may be delivered by third parties. Their own terms and privacy rules apply to their services. Onyx does not control a broadcaster's availability, content, licensing, accuracy or security.

Radio can be disabled in settings. The server operator is responsible for selecting and configuring its authentication and hosting providers.

8. Updates and security

Onyx may offer updates that fix defects, improve security or change features. The apps tell you when an update is available and wait for your action before downloading or installing it. You are responsible for keeping the app, server, operating system and third-party services reasonably current.

Internet-facing servers must use HTTPS, restrict access, protect credentials, keep backups where appropriate and follow the security guidance shipped with the server. Never publish secrets or access tokens.

9. Reports and enforcement

Report suspected illegal content, infringement, abuse or unauthorized access to the operator of the server involved. A report should identify the exact item and where it appears, explain why it is unlawful or violates these terms, provide a way to reply and confirm that the report is made in good faith. Do not send a password or access token.

The server operator may investigate, restrict access, remove an allow-list entry, remove content they control or delete an account where reasonably necessary. Onyx has no automated moderation or automated suspension system. Enforcement decisions are made by a person, must not be arbitrary and remain subject to applicable law. Where the law requires it, the operator must acknowledge a report, explain its decision and identify available ways to challenge that decision.

10. Digital Services Act

The EU Digital Services Act, Regulation (EU) 2022/2065, applies to providers of defined intermediary services. The publisher currently provides downloadable software and an informational website. It does not operate users' servers or store and disseminate information that server users submit. Onyx is not designed as a public content-sharing platform, marketplace or social network.

A private household server does not become an online platform merely because approved household members can connect to it. An operator that offers Onyx as a commercial, public or user-content hosting service must assess its own role and territory. If the Digital Services Act applies, that operator is responsible for all duties relevant to its classification, including:

• publishing the required electronic points of contact for authorities and service recipients;
• describing content restrictions, moderation tools and enforcement procedures clearly in its terms;
• providing an accessible electronic notice-and-action mechanism for allegedly illegal content;
• processing notices promptly, diligently, objectively and without arbitrary treatment;
• giving confirmations, decisions, statements of reasons and redress information where required;
• making required reports to authorities and publishing transparency reports unless an exemption applies; and
• respecting the prohibition on imposing a general obligation to monitor user information.

The Digital Services Act does not replace the GDPR. Personal data contained in a report, investigation or decision must also be handled under the Privacy Policy and applicable data-protection law.

11. Leaving Onyx

You may sign out, remove a local profile, clear watch history, export server data and delete your account through the apps. Uninstalling an app removes that installation but does not by itself delete a server account. Use the in-app account deletion action for that purpose.

These terms end when you stop using Onyx and delete any account, but provisions about ownership, lawful media, disclaimers, liability and disputes continue where their nature requires it.

12. Availability and warranties

Onyx is provided free of charge and "as is". To the extent permitted by law, the publisher and server operator do not promise uninterrupted availability, compatibility with every device, preservation of a media library or that every third-party service will remain available. Keep independent copies of media and configuration you cannot replace.

Nothing in these terms excludes a warranty, remedy or consumer right that mandatory law does not allow the parties to exclude.

13. Liability

To the extent permitted by mandatory law, the publisher is not liable for media loss, loss of settings, service interruption, third-party content, unauthorized server configuration or indirect loss arising from free use of Onyx. A server operator remains responsible for their server, library, users, providers and legal obligations.

These limits do not apply to liability that cannot lawfully be limited, including liability caused intentionally or, where applicable, by gross negligence.

14. Changes

The publisher may update these terms for legal, security or product reasons. A material change receives a new effective date and should be shown before it applies to an account. Continued use after valid notice means the updated terms apply, except where mandatory law requires express acceptance or another procedure.

15. Law, disputes and contact

These terms are governed by Norwegian law. Mandatory consumer protections and jurisdiction rules in your country remain unaffected. Try to resolve a dispute with the publisher or relevant server operator first. If that does not work, disputes may be brought before the competent Norwegian courts or another court required by mandatory law.
